Your access to and use of the Judy Ben-Asher Wellness, LLC website (judybenasher.com) and all associated content, programs, services, and platforms (collectively, the “Site”) is governed by the terms and conditions of this Terms of Use agreement and the Privacy Policy contained herein (collectively, the “Terms of Use”).

By accessing or using the Site, you accept and agree to be bound by these Terms of Use, which may change from time to time. If you do not agree to the Terms of Use, you should not access or use our Site. If you do not comply with these Terms of Use, we reserve the right to terminate your access to this Site or any part thereof.

PART ONE: TERMS AND CONDITIONS

1. ACCESS AND USE

Your use of the Site is intended for personal, non-commercial use only. In accessing or using the Site, you agree to comply with all applicable federal, state, and local laws.

Except as expressly permitted by these Terms of Use or any other applicable agreement, you agree that you will not use, reproduce, distribute, publicly display, publicly perform, publish, transmit, create derivative works from, or otherwise unlawfully use any content owned by Judy Ben-Asher Wellness, LLC.

If you purchase downloadable content or access free downloadable content from the Site (including but not limited to the Identity Stabilization Map™, workbooks, guided meditations, or any other digital resources), your access and use of such material is limited to personal, non-exclusive, non-commercial, non-assignable, non-transferable use only.

2. COMMUNITY GUIDELINES

Judy Ben-Asher Wellness, LLC fosters a safe, supportive, and trauma-informed community. By accessing and/or using the Site, any associated community spaces, or program containers (including but not limited to the TruthSeeker® Private Community, group coaching containers, and Kajabi-hosted spaces), you agree to comply with the following Community Guidelines:

• You will comply with all applicable laws in your use of the Site and community spaces and will not use them for any unlawful purpose
• You will not upload, post, email, transmit, or otherwise make available any content that infringes any copyright, trademark, right of publicity, or other proprietary rights of any person or entity
• You will not upload, post, email, transmit, or otherwise make available any content that is defamatory, libelous, indecent, obscene, invasive of another’s privacy, promotes violence, or contains hate speech (speech that attacks or demeans a group based on race, ethnic origin, religion, disability, gender, age, veteran status, sexual orientation, or gender identity)
• You will not disclose any sensitive or personal information about another person, including their email address, postal address, phone number, or any similar information
• You will not “stalk,” threaten, or otherwise harass another person
• You will not spam or use the Site or community spaces to engage in any commercial activities or solicitation
• You will not access or use the Site to collect any market research for a competing business
• You will not impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity
• You will not interfere with or attempt to interrupt the proper operation of the Site through the use of any virus, device, software, or routine, or access or attempt to gain access to any data, files, or passwords through hacking, data mining, or any other unauthorized means
• You will not use any robot, spider, scraper, or other automated means to access the Site for any purpose without our express written permission
• You will not take any action that imposes or may impose an unreasonable or disproportionately large load on our technical infrastructure
• No recording or screenshotting: You will not record, screenshot, photograph, or capture in any form any live session, group coaching call, community discussion, or private program content, whether by audio, video, screen capture, or any other means. All session recordings are provided exclusively by Judy Ben-Asher Wellness, LLC through the private Kajabi portal. Unauthorized recording or capture of any kind is strictly prohibited and may result in immediate removal from the program and community without refund
• Confidentiality within group spaces: You will maintain the absolute confidentiality of all information shared by other participants within any community, group coaching, or program container. This includes but is not limited to personal stories, family details, health information, emotional disclosures, and any identifying information shared during live sessions, in chat spaces, or through any community platform. What is shared in the group stays in the group. Violation of group confidentiality is taken extremely seriously and may result in immediate and permanent removal from the program and all community spaces without refund
• Social media sharing policy: You will not share, repost, screenshot, paraphrase, or otherwise make public any other participant’s story, experience, comments, or personal information on any social media platform, blog, podcast, or public forum without that individual’s separate, explicit written consent. If you wish to share your own experience in the program publicly, you are welcome to do so, but you may not identify, reference, or include details about other participants, their stories, or their personal journeys. This applies to all platforms including but not limited to Instagram, TikTok, YouTube, Facebook, Substack, X (Twitter), and any other public or semi-public channels
• You will notify us of any inappropriate content of which you become aware

 

Consequences for violations: Judy Ben-Asher Wellness, LLC reserves the right, in our sole and absolute discretion, to deny you access to the Site, any community space, or any program, or any portion thereof, without notice, and to remove any content that does not adhere to these Community Guidelines. Serious or repeated violations — including but not limited to stalking, harassment, threats, unauthorized recording, confidentiality breaches, or sharing other participants’ information publicly — may result in immediate and permanent removal from all programs, community spaces, and the Site without refund. We may also pursue legal action where appropriate to protect the safety and privacy of our community members.

3. INTELLECTUAL PROPERTY

Judy Ben-Asher Wellness, LLC owns the content on the Site, including but not limited to programs, services, text, photographs, illustrations, images, designs, graphics, files, information, instructions, workbooks, guided meditations, scripts, frameworks, audio recordings, video content, session recordings, advertising copy, website layout and design, and software (collectively, “Content”), any and all derivative works or enhancements of the Content, and all intellectual property rights to the Content, unless otherwise expressly stated on the Site.

By accessing or using the Site and/or Content, you do not acquire any right, title, or interest in the Site or the Content. You may not copy, distribute, publicly perform, publicly display, or create derivative works from any copyrighted work available or accessible on the Site without our express written permission.

4. COACHING AND WELLNESS DISCLAIMER

The coaching services, content, programs, and resources provided by Judy Ben-Asher Wellness, LLC are intended for educational, informational, and personal development purposes only.

Judy Ben-Asher is a certified Health Coach, Certified NLP Practitioner, and holistic health practitioner. She is not a licensed therapist, psychologist, psychiatrist, medical doctor, or mental health professional.

Nothing shared on this website, in any program, session, podcast, video, guided meditation, community space, or written content constitutes medical advice, psychological treatment, or therapeutic intervention.These services are not a substitute for professional medical care, licensed mental health treatment, or emergency services.

6. FEES AND PAYMENTS

As consideration for any purchase you make through the Site or through our program platforms, you shall pay Judy Ben-Asher Wellness, LLC all applicable fees and taxes.

You must provide current, complete, and accurate billing information. You must promptly update all billing information to keep your account current and accurate, and you must promptly contact us if you become aware of a potential breach of account security.

A. Programs and Services

Our programs, including the Identity Integration Intensive™, are delivered through the Kajabi platform via private links. Program sessions, recordings, workbooks, and materials are accessible through your private Kajabi portal. Access to program materials is for enrolled participants only and is non-transferable.

B. Digital Products

Digital products (including but not limited to the Identity Stabilization Map™, the DNA Discovery Integration Roadmap™, guided meditations, and other downloadable resources) are delivered electronically. We recommend saving all downloaded materials upon receipt.

C. Pricing

All programs, products, and services listed on the Site and their descriptions, including pricing, are subject to change. Judy Ben-Asher Wellness, LLC reserves the right to modify, suspend, or discontinue the sale of any program, product, or service at any time with or without notice.

D. Payment Terms

You agree to pay the price applicable for each program or product as of the date you submitted your enrollment or order. Payment is due in full at the time of enrollment or purchase unless a payment plan has been arranged in writing. Failure to complete payment plan installments may result in suspension of access to program materials and services.

E. Refund Policy

For the Identity Integration Intensive™: If, after attending the first session of the program, you determine that it is not the right fit for you, you may request a full refund. Refund requests must be submitted in writing within seventy-two (72) hours of the completion of the first session. No refunds will be issued after the second session has begun.

For digital products and downloadable resources: Due to the digital nature of these products, Judy Ben-Asher Wellness, LLC does not accept returns or provide refunds for purchased digital products — no exceptions.

Refunds, where applicable, will be processed to the original payment method within fourteen (14) business days of receiving a written refund request.

7. COMMUNICATIONS WITH US

Although we encourage you to email us, we do not want you to, and you should not, email us any content that contains confidential information that you do not wish to share. With respect to all emails and communications you send to us, including but not limited to feedback, questions, comments, suggestions, and the like, we shall be free to use any ideas, concepts, know-how, or techniques contained in your communications for any purpose whatsoever, including but not limited to the development and improvement of our programs and services, without compensation or attribution to you.

8. THIRD-PARTY PLATFORMS AND TOOLS

Our programs and services may utilize third-party platforms including but not limited to Kajabi, Zoom, Voxer, and payment processors. Judy Ben-Asher Wellness, LLC is not responsible for the privacy practices, terms of service, or technical performance of third-party platforms. You are encouraged to review the terms and privacy policies of any third-party platforms used in connection with our programs and services.

9. LIMITATION OF LIABILITY

YOU AGREE THAT YOUR ACCESS TO AND/OR USE OF THE SITE AND/OR ITS CONTENT IS AT YOUR OWN RISK.

You agree that Judy Ben-Asher Wellness, LLC and its owner, officers, directors, employees, partners, successors, agents, and affiliates will not be liable for any indirect, incidental, consequential, or special damages in connection with these Terms of Use, the Site, the Site Content, or any programs, products, or services, regardless of whether such damages were foreseeable.

In no event shall the cumulative liability of Judy Ben-Asher Wellness, LLC and its owner, officers, directors, employees, partners, successors, agents, and affiliates exceed the total payments made by you to Judy Ben-Asher Wellness, LLC in the preceding six (6) month period or fifty dollars ($50), whichever is greater.

These limitations of liability shall apply to the fullest extent permitted by law.

10. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Judy Ben-Asher Wellness, LLC and its owner, officers, directors, employees, partners, successors, agents, and affiliates from and against any and all claims, liabilities, losses, damages, obligations, costs, and expenses, including reasonable attorneys’ fees and costs, arising out of, related to, or that may arise in connection with your access to or use of the Site, its Content, our programs or services, and/or any actual or alleged violation or breach by you of these Terms of Use.

11. DISCLAIMER OF WARRANTY

You understand and agree that the Site, its Content, and the information, materials, programs, and products are provided on an “AS IS” and “AS AVAILABLE” basis without any warranties or representations of any kind, express, implied, or statutory, including but not limited to warranties of title, non-infringement, implied warranties of merchantability or fitness for a particular purpose, accuracy, reliability, completeness, currentness, or timeliness of the content provided on the Site.

You agree that you are solely responsible for any damage to your computer system or loss of data that may result from accessing, using, or downloading any material or product from the Site. We do not guarantee the security of any information transmitted to or from the Site or that your use or access to the Site will be error-free or virus-free.

These disclaimers of warranty shall apply to the fullest extent permitted by law.

12. DISPUTE RESOLUTION

Any disputes arising under or relating to these Terms of Use, the Content, or the Site shall first be addressed through good-faith mediation. If mediation does not resolve the dispute within thirty (30) days, either party may pursue binding arbitration in accordance with the rules of the American Arbitration Association (AAA) or JAMS.

IF EITHER PARTY CHOOSES ARBITRATION, NEITHER PARTY SHALL HAVE THE RIGHT TO LITIGATE SUCH CLAIM IN COURT OR TO HAVE A JURY TRIAL, EXCEPT EITHER PARTY MAY BRING ITS CLAIM IN ITS LOCAL SMALL CLAIMS COURT, IF PERMITTED BY THAT SMALL CLAIMS COURT’S RULES AND IF WITHIN SUCH COURT’S JURISDICTION.

Each party will be responsible for paying any filing, administrative, and arbitrator fees in accordance with applicable arbitration rules. The arbitration may be conducted in person, through the submission of documents, by phone, or online.

13. CLASS ACTION WAIVER

You agree that any arbitration or proceeding shall be limited to the dispute between Judy Ben-Asher Wellness, LLC and you individually. To the full extent permitted by law, no arbitration or proceeding shall be joined with any other, there is no right or authority for any dispute to be arbitrated on a class action basis, and there is no right or authority for any dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.

YOU AGREE THAT YOU MAY BRING CLAIMS AGAINST JUDY BEN-ASHER WELLNESS, LLC ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

14. TERMINATION

Your sole right with respect to dissatisfaction with the Site, Content, or these Terms of Use is to stop accessing or using our Site or Content. We reserve the right to terminate, suspend, or block your access to the Site and/or its Content at any time for any reason in our sole discretion.

Any termination, suspension, or restriction shall not affect your obligations under these Terms of Use. Provisions relating to intellectual property, licenses, limitations of liability, indemnification, and payment shall survive such termination, suspension, or restriction.

15. GOVERNING LAW, JURISDICTION, AND VENUE

These Terms of Use shall be construed in accordance with the laws of the state in which Judy Ben-Asher Wellness, LLC is registered, without regard to its conflict of laws rules. You agree to the exclusive jurisdiction and venue of the state and/or federal courts located in the county where Judy Ben-Asher Wellness, LLC maintains its principal place of business.

16. MODIFICATIONS TO TERMS OF USE

Judy Ben-Asher Wellness, LLC reserves the right to update or modify these Terms of Use at any time. Changes will be effective upon posting to the Site. Your continued access to or use of the Site after such changes constitutes your acceptance of the updated Terms of Use. We encourage you to review these Terms of Use periodically.

17. MISCELLANEOUS

These Terms of Use and the Privacy Policy contained herein constitute the entire understanding and agreement between you and Judy Ben-Asher Wellness, LLC. We may assign our rights and obligations under these Terms of Use. You may not assign, transfer, or sublicense any of your rights or obligations under these Terms of Use without our prior written consent.

If any provision of these Terms of Use is found to be unenforceable, void, or unlawful, then that provision shall be deemed severable from these Terms of Use and the remaining provisions shall remain in full force and effect.

The failure of Judy Ben-Asher Wellness, LLC to exercise or enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision.
